Terms of service
These terms apply when your firm signs up for or uses Kesslan. Please read them before you start your trial. If anything is unclear, ask us before you sign up.

1. Who we are
Kesslan is provided by VEXORASERVICES LTD (company no. 16673276), registered office 82 James Carter Road, Mildenhall, Bury St Edmunds, IP28 7DE, trading from Hull, United Kingdom (“we”, “us”). You can contact us on info@vexotheagency.co.uk or 01482 765408.
Kesslan is for businesses. By signing up, you confirm you are doing so on behalf of a business and that you have authority to agree to these terms for it (“you”, “your firm”).
2. Your free trial
Studio and Firm start with a 14-day free trial. We ask for a card or Direct Debit when you sign up, but we don't take any payment during the trial.
We'll email you 3 days before your trial ends. If you cancel before the trial ends, you won't be charged. If you don't cancel, your subscription starts automatically when the trial ends and we take your first payment for the plan and billing period you chose.
We offer one free trial per firm. Private starts with a demo and is agreed separately in writing.
3. Plans, prices and VAT
Prices are shown on our pricing page and include VAT at the current rate, so the price you see is the price you pay. Plans are priced per firm and include the users, branches and features listed for that plan.
Monthly plans are billed monthly in advance. Annual plans are billed yearly in advance. Payments are taken by our payment provider, Stripe, by card or Direct Debit.
We may change our prices. We'll give you at least 30 days' notice by email, and the new price applies from your next billing date after that notice. If you don't want to continue at the new price, you can cancel before it applies.
4. Changing or cancelling your plan
You can move to a bigger plan at any time. The change applies straight away and we charge the difference for the rest of your billing period.
Monthly plans can be cancelled at any time. Your plan stays active until the end of the month you've paid for, and then stops. We don't refund part months.
Annual plans run for 12 months and renew each year unless you cancel before the renewal date. We'll remind you before it renews. We don't refund part years, except where the law requires it.
If a payment fails, we'll let you know and try again. If it still hasn't been paid after 14 days, we may pause your access until it is.
5. Setup, migration and training
Every plan includes setup, data migration and training, as described for that plan. We'll agree with you what we're moving and when. We'll take care with your data, but you're responsible for checking it once it's moved and for keeping your own copies of anything important until you're happy.
6. Your data
Your firm owns the data you and your team put into Kesslan, including your clients' details and messages (“your data”). You can export it at any time, and if you leave we'll help you take it with you. We delete your data within 90 days of your subscription ending, unless you ask us to delete it sooner or the law requires us to keep it.
When we handle personal data in your data, we do so as your processor, only on your instructions and to provide Kesslan. Our data processing terms, which form part of these terms, are available on request and set out how we protect it. You're responsible for having a lawful basis to hold and use the personal data you put into Kesslan.
We use your data only to provide and support Kesslan for your firm. We never sell it, never share it with advertisers and never use it to train public AI models.
7. Kess, our AI assistant
Kess uses an AI model to draft replies, summarise conversations and answer questions about your firm. AI can make mistakes. You're responsible for checking anything Kess drafts before it's sent, and for the messages your firm chooses to let Kess send automatically.
8. Using Kesslan properly
Please keep your sign-in details safe and use two-step sign-in, which is required for every account. Don't use Kesslan to send spam or unlawful messages, to break the terms of the channels you connect (such as WhatsApp or Instagram), to try to get around our security, or to harm others. We may suspend accounts that do, and we'll tell you why.
9. Connected services
Kesslan connects to services run by other companies, such as Google, Microsoft, WhatsApp, Instagram, Xero and Stripe. Their own terms apply when you use them, and we aren't responsible for changes they make or for their availability.
10. Availability and support
We work hard to keep Kesslan available and secure, but we can't promise it will always be uninterrupted or error-free. We'll tell you about planned maintenance in advance where we can. Support is by email on Studio and through a named account manager on Firm.
11. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.
Otherwise, we're not liable for loss of profits, revenue, business or goodwill, or for any indirect loss. Our total liability to you in any 12 months is limited to the fees you paid us for Kesslan in those 12 months.
12. Ending these terms
You can end these terms by cancelling your plan as described above. We can end them by giving you 30 days' notice, or straight away if you seriously break them and don't put it right within 14 days of us asking. If we end them without cause, we'll refund any fees you've paid for the time after your access ends.
13. Changes and the law
We may update these terms. We'll email you about important changes at least 30 days before they apply. These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute.
